Ftc No Call List Questions asked

Resolved Question: It MUST be illigal for an offshore company to send remote signals to my cell phone turning it back ON?

I have been getting several calls per day from 866-740-4398 from a machine that begins by asking me for my Social Security Number. There is no way to reach a real person. The calls come at all times of the day, including when I am trying to sleep. Then my cell phone keeps beeping all night long to remind me that I missed a call. I have tried turning off the phone, but they have some sort of bypass that allows them to remotely turn my cell phone back on. It is a Motorola phone -- no bells and whistles, just the cheapest phone. My cell phone provider says they can to nothing and referred me to the FTC. The FTC says they can do nothing (because I use the phone partly for business) and refered me to my cell phone provider. I am on the Do Not Call list. I get my service from my regular phone company, RT Communications, which gets its service from Verizon. I live in a rural area where Verizon is the only company that has cell phone towers. I can't ask for a new number because my cell phone is on my business cards and besides, it is the only number my friends and relatives know to reach me. It MUST be illegal for them to reach into my house from the Philippines and turn my phone on!RT claims they can't block the number; neither will Verizon, since I don't get my service directly from them. more

Resolved Question: Please Help!!! Identity Theft!!!?

Someone was renting apartments in my name and got evicted from all of them. Now I'm under Public Records as someone who has evictions!!! They're not mine, it's all fraudulant, what do I do???? I called local police, FBI, public defender, local and distant courts, district courts, general attorney's office, district attorneys office, lawyers, FTC, social security and the list goes on!! NO ONE IS ABLE TO HELP ME!!! What do I do to clear my name of all of this!!! more

Resolved Question: How can this be legal? (about Identity theft)?

Ok so someone stole my identity almost 2 years ago. I put a fraud alert on my credit which requires that I get a phone call to authorize any credit inquiries and have not had any issues since resolving all of the issues last year. Now, I get a phone call 2 days ago telling me that I owe $1000 for a Payday loan taken out in my name. They were really rude to me and obviously think I am a scammer when really I have once again been scammed. Anyways, here are the reasons I am confused as to how this could happen: *Payday loan taken out over a website, not in person *They listed my address in Florida *They used a bank account which deposit was made to was not in my name *The bank account they used is in Michigan *The bank account contact info and home address as well as my name do not match *They did not check my credit for a payday loan *They are threatening to report it on my credit report in 5 business days if I haven't overnight mailed a police report to them So how can I be pushed into a corner over this?! I am furious. I've already filed a report with the FTC, made a police report, and I've done everything I've been told to do. But these people are demanding that I buy a copy of my police report to send to them (It costs $15 at my local police station) and then pay to have it overnighted. If I don't do this today they are saying they're gonna report it to my credit in a couple days. It seems to me that being so careless on who they give money to should be illegal...is it? How can you let someone take out a payday loan and put it in someone elses bank account, and on top of it, its all online so theres no way to verify identity through picture ID. I've told them I am mailing the legal FTC affidavit tomorrow but they say thats not good enough. Second issue is, these people have been torturing me for 2 years. They racked up a decent amount of damage 2 years ago, then last year I found out they "piggybacked" to use my credit by taking out a new home cable-internet-phone service in my name. It slipped though the cracks because I already had that service provider. So they didn't have to run my credit that time either. And now they are taking out Payday loans in my name which don't require a credit check. So how will this ever end? They could do this to me forever it seems like :( And I am trying to get a job at a bank but I would be denied based on poor credit over this. It's really draining me of energy and I just feel like giving up :( What should I do? P.S. The logical thing to do would be to ask the police for help, right? Well only if the police were willing to help, which they are not :( more

Resolved Question: are telemarketers required to give any information?

I've been getting telemarketer calls from the same company for some time now. I'm trying to file a report against the company ( I'm on my state's do-not-call list) but I can't get any information out of them, no address, in-bound phone number, nothing. Is there any information telemarketers are required to provide when asked by any federal laws, state laws, or ftc guild lines? more

Resolved Question: Why is it that people call for people at someone's house that the person don't know but do it over and over?

Don't you think that you have a right to charge someone an X amount of Dollars for calling for someone that isn't there and repeats on doing it after you have told them that person don't live there? I have had the same people call over and over and ask for a person that I don't even know and they have refused to stop calling Every offense is worth $ 11,000.00 according to www.donotcall.gov *Reminder: Even if your number is registered, companies with which you do business may continue to call you. So may charities, political organizations, and telephone surveyors. more information about the companies that may continue to call the numbers on the registry https://www.donotcall.gov/complaint/complaintcheck.aspx http://www.ftc.gov/bcp/edu/pubs/consumer/alerts/alt107.shtm I picked out some of the questions and answers on www.donotcall.gov Why would I register my phone number with the National Do Not Call Registry? The National Do Not Call Registry gives you an opportunity to limit the telemarketing calls you receive. Once you register your phone number, telemarketers covered by the National Do Not Call Registry have up to 31 days from the date you register to stop calling you. When I register my phone number, how long until it shows up on the National Do Not Call Registry? After you register, your phone number will show up on the registry by the next day. Telemarketers have up to 31 days to get your phone number and remove it from their call lists. If I registered by phone, will I receive a confirmation? No, but you can verify that your number is on the registry online at www.donotcall.gov or by calling the registry’s toll-free number (1-888-382-1222) and following the prompts for verifying that your number is on the registry. If I choose to register my phone number, how will my information be used and disclosed? We collect your phone number and store it in the National Do Not Call Registry so that telemarketers and sellers covered by the FTC’s rules can remove your phone number from their call lists. Telemarketers are required to search the registry every 31 days and delete from their call lists phone numbers that are in the registry. Phone numbers in the registry also may be shared with law enforcement to assure compliance with federal and state law. If you contact us via the Internet, we also collect your email address to confirm your registration request. We will store your email address in a secure manner, separate from your telephone number. We will not share your email address with telemarketers. Can I register all my family and friends? You should register only your own telephone numbers. What happens if I register more than one number at a time online? You will get an email for each number you register online. You need to open each email and click on the link in each email within 72 hours to register those numbers. I moved and got a new phone number. Do I need to register the new number? Yes. Can I register online if I do not have an active email address? No. The online registration process requires an active email address. If you register online, we will send you an email message with a link in it. You need to click on the link in the email within 72 hours to finalize your registration. If you do not have an email address, you can register by phone (1-888-382-1222). If I register my number on the National Do Not Call Registry, will it stop all telemarketing calls? No. Placing your number on the National Do Not Call Registry will stop most telemarketing calls, but not all. Because of limitations in the jurisdiction of the FTC and FCC, calls from or on behalf of political organizations, charities, and telephone surveyors would still be permitted, as would calls from companies with which you have an existing business relationship, or those to whom you’ve provided express agreement in writing to receive their calls. Are calls from political organizations or calls soliciting for charities covered? Political solicitations are not covered by the TSR at all, since they are not included in its definition of “telemarketing.” Charities are not covered by the requirements of the national registry. However, if a third-party telemarketer is calling on behalf of a charity, a consumer may ask not to receive any more calls from, or on behalf of, that specific charity. If a third-party telemarketer calls again on behalf of that charity, the telemarketer may be subject to a fine of up to $11,000. If I don’t want to put my number on the National Do Not Call Registry, can I still stop telemarketers from calling? Yes. Even if you do not register with the National Do Not Call Registry, you can still prohibit individual telemarketers from calling by asking them to put you on their company’s do not call list. What is the relationship between the state do not call lists and the National Do Not Call Registry in terms of coverage? The National Do Not Ca more

Voting Question: Obama, can you make sure you reform donotcall.gov? ?

It should be obvious that a lot of us folks would want our phone number be part of a universal do not call, period! no surveyors, politics, any calls at all. in fact, i think u can make more money if you prosecute these offender! what do you say obama, give us the option to have complete op out. If the FTC cant' handle it, then let another branch handle it. From the way i look at it, the government is making a money off the people by selling the list of do not calls, yet at the same time, we aren't given the option for complete opt out! more

Resolved Question: Company won't remove us from their telemarketing call list?

Could anyone could lend me their advice on how to get our business number permanently removed from a company's calling list? The FTC says that their do not call list is not for business use, what to do? This is taking up a lot of my time There is a company that has been calling a couple times a week for the last 3 months. Each time they call I tell them to take us off their list. They say "ok" and hang up. Today, they called again and as usual, I let her know that you have to remove someone from your list if they ask to be removed. I am getting really frustrated! Today, the caller told me that she can remove me from her calling list but cannot stop the other 1,500 employees at this business from calling me. IS THIS TRUE?? What info would I need to take action, & does the phone co block all numbers from certain companies if you ask? I have had no luck finding this bus. on the internet, and only was able to get one direct line number of one of the callers. Thank you!! more

Resolved Question: Soliciting cell phone calls- where to report?

I've been receiving calls and voice mail messages from an 800 number on my cell phone. It's been wasting my minutes and I know the only way to stop it is to change my cell phone number- but I also know that soliciting cell phones is illegal! (For those of you that think cell phones must also be registered on the DNC List, read this: http://www.ftc.gov/opa/2007/02/dnccellphones.shtm ) The trouble is, I have no idea where to report this or who to report it to. more

Resolved Question: Amcapital loans ALERT!!!!!?

COMMONWEALTH OF MASSACHUSETTS OFFICE OF CONSUMER AFFAIRS AND BUSINESS REGULATION 10 Park Plaza - Suite 5170, Boston MA 02116 (617) 973-8700 FAX (617) 973-8799 TTY/TDD (617) 973-8790 www.mass.gov/consumer DEVAL L. PATRICK GOVERNOR TIMOTHY P. MURRAY LIEUTENANT GOVERNOR DANIEL C. CRANE DIRECTOR FOR IMMEDIATE RELEASE: April 19, 2007 CONTACT: Kimberly Haberlin (617) 973-8767 (617) 947-8942 Consumer Affairs Issues Consumer Alert on Advance-Fee Loan Scam And Pay Day Loans BOSTON - The Office of Consumer Affairs and the Division of Banks today issued a consumer alert warning consumers about a potential advance-fee loan scam and an illegal pay day loan operation recently advertised in the Boston Metro. ADVANCE-FEE LOAN SCAM Advance-fee loan scams generally involve the promise of easy credit regardless of credit history. Upon completion of a loan application, the entity requires a consumer to wire a percentage of the loan amount, various fees, or payment of insurance in order to secure the loan. Upon collection of the fee, the loan is never delivered. Amcorp Capital is operating a website at www.amcorpcapital.com. The only contact information provided on the web site is a toll free telephone number and an email address. The web site also lists a business address of One Boston Place, Boston, Massachusetts. Amcorp Capital claims to offer mortgage loans, education loans, personal loans, and automobile loans. This entity is not licensed by the Division of Banks and calls to the company have not been returned. An investigation by the Division of Banks has determined that no such business is located at the One Boston Place address. Moreover, the Amcorp Capital’s web site was apparently created on April 11, 2007. Similar to other advance-fee loan scams, the website promotes the availability of easy credit regardless of credit history. Based upon discussions with consumers, Amcorp apparently requires, upon completion of a loan application, that a percentage of the loan be paid up front directly via wire transfer. The Office of Consumer Affairs and Division of Banks strongly urges consumers not to do business with this entity. “This has all the earmarks of an advance-fee loan scam,” noted Director of Consumer Affairs Daniel C. Crane. “Consumers should know that no legitimate lender would require an upfront payment to secure a loan. Consumers should also be extremely cautious when dealing with companies that you do not know. All efforts should be made to safeguard your personal information such as bank account, credit card, or social security numbers. For more information on advance loan scams please see information from the Federal Trade Commission available at http://www.ftc.gov/bcp/conline/pubs/tmarkg/loans.shtm. ILLEGAL PAY DAY LENDER Director Crane also announced that Commissioner of Banks Steven L. Antonakes had sent a letter to the Boston Metro requesting that the publication cease accepting print advertisements from pay day lenders. Commissioner Antonakes sent a similar letter to the Boston Metro in February 2005 and the newspaper, until recently, had not run advertisements for pay day lenders. “Pay day loans carry exorbitant interest rates and can quickly lead consumers into escalating debt,” said Director Crane. “There is also a high risk of identity theft as this company’s advertisement provides virtually no identifying information.” Commissioner Antonakes added, “There are no payday lenders licensed or based in Massachusetts. Under the state’s small loan law, annual interest rates on these loans are capped at 23% and fees are limited to $20. Pay day lenders typically charge annual percentage rates averaging 300 percent and fees averaging $30.” Pay day loans are short term, small sum, high rate, unsecured personal loans that use consumer checking accounts (either post-dated checks or electronic access) to secure repayment of the amount borrowed. Repayment of the full amount and lender fees are typically due within 14 days or with the borrower's next paycheck. Partial payments are rarely allowed so if a borrower can't repay the full amount within the required timeframe, the loan is usually rolled over for additional periods of time and additional fees. If you believe you have been a victim of this advance-fee loan scam or pay day loan operation, call the Division of Banks’ Consumer Assistance Unit at 1-800-495-BANK (2265).DON'T FALL FOR THIS COMPANY!!! more
