Open Question: Non Moving Traffic Violation?

I received an obstructive view ticket this morning for a radar detector mounted on my front windshield. Luckily the ticket is a non-moving traffic violation so I will not receive any points for the ticket. The reason I was pulled over according to the officer, "I was coming up too fast on the car in front of me". Obviously it was a bs excuse to pull me over any give me a ticket for the radar detector. After doing some research online, I've come to the conclusion that it is indeed an offensive and there is no way to prove my innocence in court, so I'm going to plead guilty and pay the $54 fine. This got me thinking about how to avoid non moving traffic violations in the future, specifically obstructive view. My understand of how cops give them out is they first have to pull you over for reason x, then when the car is stopped can cite you for non moving violations. My question is if I get pulled over in the future, is a cop allowed to cite me for an obstructive view if I take the radar off the windshield before he comes over to my car? My thought process is since there is not an obstructive view while the vehicle is stopped, a cop cannot give the ticket. Thoughts?Edit: @Vision I understand what you are saying and follow the logic, but what I am trying to understand is what the definition of a non moving violation is and on what basis are those tickets handed out. Doesn't that mean the vehicle is not moving? So in order to give a NMV ticket the vehicle has to be stationary. Thus, a cop can't give a NMV ticket for an infraction seen for a vehicle in motion (radar detector on windshield). If the radar is taken down before coming to a complete stop, there is no infraction and a NMV ticket can't be given. more

Open Question: help with wicked stepmother, legal?

Let me start by saying that I was adopted by my paternal grandfather when I was 4 years old. I call him DAD. His wife was not my grandmother, she was his 2nd wife, I call her MOM. My biological dad is still alive, but I call him by his name. My biological mother died when I was 7 years old. So when I mention my DAD, I really mean my grandfather. K, so, my DAD and MOM got a divorce when I was 12. When I was 13 I went to live with my DAD and his girlfriend. We got along for a while. Then when I decided to go through a gothy phase and experiment with smoking, drinking, stuff that kids do, my dad's girlfriend flipped and has hated me ever since. I understand that I was misbehaving and that I did deserve punishment, which I most certainly got. My dad has always loved me unconditionally, but he did punish me when necessary. Over the years, she took it into her own hands to punish, degrade, and torment me. She disrespected my dad constantly, even getting jealous if we were watching tv together. He rarely tried to stand up for me and just let her do whatever, so that she wouldn't kick us out. I don't understand this because my dad co-signed for her house and he paid most of the bills. My dad remained unmarried to her a little while after the divorce was final, then she gave him THE ultimatum: marry me or get out. She was 54-ish? and had never been married or had children. I told my dad that it was a bad idea, but she intervened saying that the only reason I didn't want them to be married was because I didn't like the fact that she disciplined me. So, great, they got married. Once I turned 17 I was able to get car insurance and drive. I was rarely home, always at friends houses, but I was always on time and reliable when it was time for me to come home for the night. I didn't party or do anything "bad" really, but she was always sneaking around trying to catch me doing something that I shouldn't be doing. She found out that I had called her a b*tch to a few of my friends and she threatened to press charges of slander on me so that I would "rot in jail." I have since done research, slander is a lawsuit and not a matter of jail time, and it would have to cause a loss of income for her in some way. Its not an issue for teenagers who are pissed off at their parents. Finally in late April, graduation came around. I had just received my announcements and cap/gown and took the stuff to my mom's house to work on over the weekend. I got ALL of my invitations sent except for a few that I needed to confirm the addresses, I was very proud of myself for getting most of it done. However... my stepmom ordered 50 invitations and 25 insert things. Not a big deal. But apparently it was my fault for f*cking up the orders, I couldn't do anything right, she was wanting to search my backpack for some reason. I finally snapped. Told her off, got in her face, flipped the f*ck out on her. Almost 5 years of torment and verbal abuse and I finally just told her where to stick it. My dad just stood there open mouthed, amazed that I knew so many vile words. My stepmom told me to get out (I was not 18 yet.. my birthday is in June). Dad actually told me that I could go live with my boyfriend (now husband) and he wouldn't let her call the cops on me or anything. So, I left, I finished school, turned 18, etc.. Then back in the beginning of July she told me that I had 24 hours to return her family heirlooms that I apparently stole or else she would call the police. I have never stolen anything of hers, and really, I moved out in April and I don't have a key to the house anymore. The only time that I have been in that house since then, I was visiting my dad, and he was in the same room with me the whole time. Shouldn't she have freaked out wayyy before? I have only talked to my dad a few times since this incident. I was never served with any papers or arrested. NOW the freaky part. My dad was getting approximately $900 of social security on me every month from where my biological mother died when I was 7. I always figured it was social security from him, but a conversation with my half sister recently verified that it wasn't even his money. I have never seen any of it, it was supposed to be used and/or saved for me, but my stepmom didn't let him give it to me. I suppose I'm being a bit vindictive and vengeful, but I don't really care. I reported them for social security fraud (them receiving the check for me even when I wasn't under their care) and I was wondering if there was any legal action that I could take against my stepmom, maybe because it is illegal in the state of Tennessee to kick a minor out of the house or any other legal thing that I can slam her with, as well as any advice that might help me get over frustration and anger. more

Voting Question: How do you possibly stay alive in....?

THIS World? Our families are all pushing my 18 year old sister and I to move out on our own. (I am 20). But I don't have a job, she is about to start college and they think we are too lazy and we need to move out and live on our own. I just lost my most recent job and all other possible jobs are at least 40 minutes away (rural area) and I don't have my own vehicle. How can we get a house without jobs? How can we get far away jobs without a car? How can we get a car without a job? I don't have credit because I am just starting out. So I can't get a loan. The government makes it impossible to live out there. What makes me angry is that here on the property I live on, are my grandparents in one house (with my 18 year old sis) and my Dad and his wife in another house across the driveway. Then in my grandparents house also is one of my Uncle's- who had to move back home at the age of 52, because he couldn't survive on his own anymore, and another Uncle (who I live with) that also lost his home at the age of 54 and we live in an RV on this same property as well. Resolved Question: Second speeding ticket this week (totaling 3 within 12 months)!!?

I need some help on this. Last ticket I got was 11 months ago (August 2009). Then last Tuesday I get a ticket for going 72 in a 55 zone on the highway. Two days later I get another one for going 54 in a 35 zone. This comes to a total of 3 tickets within the last 12 months. Does anyone know how many points this would add to my record? (I have 2 points from the first ticket from 11 months ago). The thing about the second ticket is that it was really a speed trap. There were two other people pulled over WHILE I was being pulled over. Not only that, but one of my co-workers received a speeding ticket from the SAME cop, at the SAME location, 30 minutes later. If the only advice you have is that I need to stop speeding then spare me. I already know that I messed up and I don't usually speed. For the second ticket, I really thought the speed limit was 65 and I dont go more than 5mph over the speed limit (but turns out it was a 55mph zone). And for the third ticket (the speed trap) I was paying attention to the cars in front of me (not the speed signs) because there were people pulled over on the side of the road and the traffic was slowing down so I was paying attention to the road, not the signs. Any way of getting out of these tickets (or at least one of them) in front of the judge? Ex. sign up for defensive driving class, or tell the judge that the officer (for the third ticket) was using a radar (calibration off?) and he clocked me while his cruiser was moving (not stationary) so he might have miscalculated my speed? recently bought the car vauxhall astra cdti 54 plate old shape. one day started the car and it would not start or do anything. had sum 1 look at it and they advised it was the starter motor. Replaced the starter motor and car was fine for 2 weeks or so .. BUT now have turned the ignition and car starts up but turns off straight away. turned the key a second time and no power. cant get it to start. eventually got it started using jump leads. thought might be battery - changed for a new one and nothing. still would not start same problem. dont know what is wrong with it? diagnostic check comes back fine . car jst wont start dont know what to do with it ? please help more

Resolved Question: Has anyone encountered rust on a 54 reg Ford SporkKA?

The car isn't even 6 years old and has done little over 30,000 miles. I have just had an MOT done and rusted door sills was an advisory. Upon inspection there were 2 x 1 inch bubbles on the near side door sill and rust down the other. I telephoned Ford who said they wouldn't do anything unless there was an actual hole or the vehicle was under 1 year old. Has anyone pushed Ford into repairing similar faults under the 'anti-perforation warranty'? Or does anyone have any suggestions? more

Resolved Question: Why wont my car start first time?

A few months ago i bought a 54 plate 1.6 Renault Grand Scenic. We have started experiencing problems with it not starting first time sometimes. It mostly happens when it has been sitting for long periods, like over night. It starts, then chugs a bit before cutting out, unless you give it some gas & it catches up with its self again. Once started we also smell petrol fumes outside the car. It also sometimes kicks out stuff from the exhaust once started. Obviously it needs to go into a garage to be looked at, but would be good to have a bit of knowledge behind me before i go, so i do not get ripped off! more

I have a 97 Dodge Intrepid. While going up a hill, my car decided to die on me. It was running fine and didn't spit or sputter before or during stopping. I can crank it all day long so I know the motor didn't lock up, but it still will NOT start. What could the major problems be? I am kinda thinking the timing might have jumped since it does have 106,000 miles on it but my hubby seems to think that its not getting enough gas, if any. Please help asap! Ran the self diagnostic system test and it gave me error 54, which is as follows: No camshaft signal detected during cranking This could be that the timing did jump, therefore the cam shaft isn't turning correct? I just changed the oil in my 2008 Acura TL, and bought a cheap air filter brand WIX. Anyway the car is auto but when I had the other filter the acceleration was noticeably and I do mean noticeably better. Now that I've installed this new cheap air filter the car doesn't accelerate as good as it used to. Ok, I've been living here in the usa for almost 14 years. I came to this country with a tourist visa which I over stayed (expiered visa) I was 14 years old when I came here and went to high school and college. I'm 27 now. During my study at my community college I met this girl at a Math class we started going out for 2 years then decided to get married. I filled for the Green Card and got denied then approved for the green card. I got the permanent resident after my marriage within 4 years which is the longest I ever heard, but I did it I have my green card now and I'm still happy married. Before I got married I was living in my parents house and my parents didn't even have the papers that time and my father was trying to do everything possible to be legal in the usa but he had to leave on a deportation proceedure. The problem now isnt with my family at all. I'm a full time college student, and I work on weekends earning £54 a week, (although after tax i'm left with £45) . My job which i plan to do when i graduate requires a driving lience and my own transport, so im currently taking driving lessons (paid for by myself) and plan to take my test next month, then after I will be saving for a cheap car. My 1 driving lesson a week costs £20, and my parents take £15 off me for rent, which leaves me with only £10, which is spent on my weekly bus ticket to get there and back for college and work. I applied for EMA, which is an allowance for students to help with transports, ect, which is £30 a week, but i'm not entitled to it as my parents earn over 30 grand a year. I feel so depressed as I have no social life as my parents take what little money i have left. My friends ask me out all the time but I can't go out as i have no money, I even miss their birthdays. They can afford to go out as they get EMA and aren't having driving lessons as they are studying a different course to me, or the ones who are having them are being paid by their parents. My parents never lend me money so that's out of the question.
